Separation Agreement ILA Checklist

Minimum items to watch out for when reviewing agreements (although obviously you'll still need to exercise your discretion).

Many items won't be deal-breakers to clients, but they should know what's missing and how the agreement could be improved.

After completing this checklist, I also send a letter to the client confirming my advice, using the ILA Remarks Letter precedent.

Questioning Template

This is the outline that I use to prepare for a Questioning for Discovery, or sometimes Questionings on Application if we want to be thorough.

It definitely doesn't address every issue, but I find that it saves time, and I believe it's better for due diligence and investigating issues than preparing from scratch.

It also contains helpful reminders, such as conducting a re-direct, issues to discuss at the outset, providing the client with paper so that you can break at the end to see if further inquiries should be made, and so on.

Organizational tool to help keep arguments precise, relevant information on hand, and handy references to costs and Rule 9.4(2). Especially useful for lawyers who are new to family law.
