Christmas/Holiday Arbitration Chambers

Edmonton QB's December Family Chambers list will probably be full by the end of the day! However, starting this year if you can't make the list, there will be a new alternative: Arbitration Chambers for Christmas/Holiday parenting time.

I understand that Christmas Arbitration Chambers is relatively common in Calgary (as is arbitration in general, compared to Edmonton). Once the court list fills up (or for those who prefer arbitration over court), families who still need their dispute resolved can instead agree to private arbitration.

The following slots are still presently available: December 17 (am), 18 (pm), or 24 (am or pm).

Although I understand that the cost is much higher in Calgary, because I'm new to arbitration, this year my fee will be a lower flat rate of $1000+GST per party. That cost includes:
  1. A brief teleconference call regarding procedure;

  2. Time spent reviewing materials (if any);

  3. One half-day chambers-like appearance; and

  4. Promptly delivering my written decision, including any re-apportionment of costs.

  5. If there are additional materials such as affidavits exceeding what would be ordinarily permitted in regular chambers, briefs, oral+written evidence, transcripts, or expert's reports, then I would charge for the extra time at half of my hourly rate each.

    What are the benefits to arbitration?
    • Potential cost savings if parties agree to a more flexible procedure than court (addressed during the initial teleconference call. E.g. no affidavits). You'll also have an exclusive time slot, so that clients won't have to pay to wait while other matters are heard.

    • Unlike regular QB chambers, the decision-maker will read your materials in advance (or where there are no written materials, spend much more time listening to the background and arguments than you would get in regular chambers).

    • You'll know ahead of time that the person making the decision is experienced in family law (I teach the Advanced Family Law course at the UofA Faculty of Law, have presented at 7 LESA seminars, 2 CBA meetings, will be presenting for ACTLA in the winter, taught Parenting After Separation for 6 years, and present to the public through ECLC).

    • No haggling over forms of order: I will prepare a written decision within 48 hours (I'm hoping to be able to deliver same day decisions though).


    I am very fortunate to be mentored by Edmonton’s highly esteemed arbitrator Norm Picard, QC. I’m in the middle of completing ADRIC’s Arbitration course (the remaining course units are focused on unrelated areas of law such as employment law arbitration, intellectual property arbitration, etc.)

This sounds like a great alternative Ken! Too bad I am pretty militant with my clients when it comes to Christmas access and shouldn't need this as an alternative for that purpose :)

Hmm, Christmas Access application or save my money and take the kids to Disneyland at a different time? What to do, what to do?

Great idea Ken, I hope those that need it take you up on it, but really I hope Disneyland gets the business.
