Family Law Practice Note 10 coming into effect next week

The Court of Queen's Bench has just announced that effective this Sunday, October 15, 2017, Family Law Practice Note 10 will come into effect.

Family Law Practice Note 10 is the new process to limit access to court files. Those who are not parties, lawyer of record, counsel for a child, a person authorized by the aforementioned, or a member of the media, will need to serve a Request to Access Family Law File and complete an Affidavit of Service in accordance with the procedure. The new Practice Note as well as the related forms can be read here.

I had a Special Chambers that was witnessed by students from the family law class at the University of Alberta. They have requested a copy of the Order. My inclination is to say "no" because of my duty of confidentiality to my client. Maybe it's me, but I would not have asked a lawyer for a copy of the court order knowing that the lawyer has a duty of confidentiality to the client.

I would be OK with sharing the order after redaction of the action number, names of parties and children and any other information that could be used to identify the parties. If you are preparing the Order in Word, you can easily substitute names (i.e. put Jane Doe, John Doe, child Doe #1, etc.) This is much safer than redacting a hard copy of the order as it is often still possible to see through felt pen or other means of blacking out information.
