On topic: I recently sent a consent order down to YEG Provincial Court to be dealt with by desk. I signed on behalf of my client and the other party signed with a witness & there's affidavit of execution. The clerk rejected the order because it was not signed by my client. She said both parties need to sign the order, despite the applicant being represented by counsel. Am I wrong to be completely flummoxed by this rejection? Or has something changed in Provincial Court regarding consent orders since I last appeared?

NOTE: My client signed an affidavit noting the agreement between the parties and referencing the signed Minutes of Settlement. This was provided alongside the consent order.

I have not had that experience with consent orders in Provincial Court and assume that is an error. I would call the clerks and see if you can get some clarification. Our office has had some random rejections (usually by a new clerk or where the document we are submitting does not fit into the Provincial Court routine materials) and usually a call fixes it.
