Family Maintenance and Support for Children

ALRI is conducting further consultation on its recommendations to reform family maintenance and support. Report for Discussion 34 recommends that children of persons who stood in the place of a parent during life be added to the list of "family members" for the purposes of family maintenance and support.

The roundtables will focus on recommendation 2 in RFD 34. ALRI recommends that a residency requirement prior to death not be included in the conditions that would qualify a person as having stood in the place of a parent during life. We hope to hear from members of the estate and family bars on what, if anything, a residency requirement adds to the legal analysis, what obstacles it might create, and what problems the inclusion of a residency requirement would avoid.
