While the Alberta Rules of Court provide a template for the factors to be considered when determining whether costs are appropriate and if so, how much, there is no clear template for a Bill of Costs. This has resulted in uncertainty and a lack of consistency, which does not serve our clients. With the perspective of decision-makers, we hope to provide insight into what a Bill of Costs in family law should look like (ie. what to include vs what not to include, especially to avoid disclosing confidential privileged information) and suggestions on how to structure it, whether you are in court or arbitration.
